1. General
These terms apply to the use of the Pinkly booking and management software (pinkly.eu). The service is provided by Pinkly OÜ. By creating an account or making a booking you confirm that you have read and agree to these terms. The processing of personal data is described separately in the privacy policy.
2. Who the service is for
- ✓Salons and specialists (hereinafter *service provider*) use Pinkly to manage appointments, clients, payments and their team.
- ✓Clients book appointments with a service provider. The contract for the service itself (e.g. a manicure) is concluded between the client and the service provider; Pinkly is only the technical intermediary.
3. Account and identity verification
Service provider and client accounts are linked to a person using Smart-ID, Mobile-ID or an ID card. You are responsible for making sure only you use your account. Pinkly never asks for PIN codes. If you suspect your account has been misused, let us know immediately.
4. Plans, trial and payments (service providers)
- ✓A new service provider gets a 14-day free trial (it may be longer with a campaign). No credit card is needed to start the trial.
- ✓After the trial, the chosen plan (monthly or annual) applies at the price shown on the Pricing page. VAT is added to the prices.
- ✓The subscription renews automatically until cancelled. You can cancel at any time in the dashboard (Settings → Plan); already paid periods are not refunded, and the service remains available until the end of the period.
- ✓A campaign discount applies for the period and plan stated in the campaign terms and cannot be exchanged for money.
- ✓If a payment fails, we may suspend online booking until the payment is received; your data is kept.
5. Deposits and discounts (clients)
- ✓The service provider may require a deposit for a booking. The deposit goes directly to the service provider's account (via Montonio) and the refund terms are set by the service provider.
- ✓Free cancellation is possible up to 24 hours before the appointment unless the service provider has set otherwise. For later cancellations, contact the service provider.
- ✓Promo codes and campaigns are offered by the service provider; their terms (validity, services, number of uses) are shown when booking.
6. Obligations of the service provider
- ✓Keep your prices, working hours and services up to date and honour the agreements made with clients.
- ✓Process client data only to provide the service and in accordance with the law. Send marketing messages only to clients who have given their consent.
- ✓Do not use Pinkly for illegal activities, spam or violating the rights of other users.
7. Availability of the service
We do our best to keep Pinkly available around the clock. We announce planned maintenance in advance; during maintenance the service may be temporarily closed. We are not liable for interruptions caused by third parties (e.g. SK ID Solutions, banks, telecom operators) or force majeure.
8. Liability
Pinkly is liable only for direct damage caused intentionally or through gross negligence, and towards a service provider at most up to the fees paid in the last 12 months. Pinkly is not responsible for the quality, price or cancellation of the service between the service provider and the client.
9. Data and termination
The service provider may terminate the contract at any time. After termination we keep the data for 30 days (so you can come back or download it), after which it is deleted or anonymised, except for data whose retention is required by law (e.g. accounting). In case of a material breach of the terms we may suspend the account.
10. Changes
We may change these terms. We will notify service providers of significant changes by email at least 30 days in advance. Continuing to use the service means accepting the changed terms.
11. Disputes and contact
These terms are governed by Estonian law. We aim to resolve disputes through negotiation; failing an agreement, in Harju County Court. Consumers may also turn to the Consumer Disputes Committee (ttja.ee).
